Privacy Policy
Protection of personal information — compliant with Quebec’s Law 25 and Canada’s PIPEDA.

1. Introduction
Performances Qualité Inc. (“we“, “our” or “PQ Inc.“) takes the protection of personal information very seriously. This policy describes how we collect, use, disclose, retain and protect the personal information entrusted to us.
This policy complies with Quebec’s Act respecting the protection of personal information in the private sector (commonly known as “Law 25”), Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), and where applicable, the European Union’s General Data Protection Regulation (GDPR) for our European clients.
2. Definitions
- Personal information: any information that allows a natural person to be identified, directly or indirectly.
- Sensitive information: information that, by its nature or context, gives rise to a high expectation of privacy (medical, biometric, financial information; information about sexual life or orientation, religious beliefs, ethnic origin).
- Consent: clear, free, informed authorisation given for specific purposes.
- Privacy Officer: the person designated as responsible for the protection of personal information at PQ Inc.
3. Information we collect
We only collect personal information necessary for our activities. Depending on the interaction, this may include:
- Professional identification: first name, last name, job title, employer
- Contact details: business email, phone number, postal address
- Exchange content: emails, quote requests, project descriptions
- Browsing data: IP address, browser type, pages visited, visit duration (see our Cookies Policy)
- Contractual data: billing and accounting information for clients under contract
4. Purposes of use
We use your personal information only for the purposes identified at the time of collection, namely:
- Responding to your information requests, quotes or appointment bookings
- Delivering our contractual services (training, implementation support, audits, regulatory inspection)
- Billing, accounting and tax obligations
- Improving our website and services
- Keeping you informed about our QHSE news, training and publications (only with your explicit consent)
- Meeting our legal and regulatory obligations
We never use your personal information for any other purpose without your explicit consent or unless authorised by law.
5. Consent
Where the law requires it, we obtain your consent before collecting, using or disclosing your personal information. You may withdraw your consent at any time by contacting us at info@performancesqualite.ca. Withdrawal may prevent us from continuing certain services.
6. Information disclosure
We never sell your personal information. We may only disclose it in the following situations:
- With your explicit consent
- To our service providers (hosting, email, accounting, partner certifying bodies) who are contractually bound by confidentiality and only use this information for agreed purposes
- To comply with a legal obligation (court order, government request, regulatory investigation)
- To protect the rights, property or safety of PQ Inc., its employees or third parties
7. Hosting and transfers outside Quebec
Information collected via this website is processed and stored in Canada by our hosting provider. If a transfer outside Quebec becomes necessary for service delivery (e.g., to a partner in Europe or Africa), we will first assess the adequacy of protections offered by the jurisdiction concerned and frame this transfer with appropriate contractual provisions.
8. Retention and destruction
We retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, and for the period required by applicable tax, accounting and regulatory laws (generally 6 to 7 years after the end of the business relationship).
Once these periods have elapsed, we destroy or anonymise the information in a secure and irreversible manner.
9. Security
We have implemented physical, organisational, contractual and technological security measures to protect your personal information against loss, theft, unauthorised access, disclosure, copying, use or modification. This includes:
- TLS/HTTPS encryption across the entire site and email exchanges
- Strong (two-factor) authentication for administrative accounts
- Access to information limited to staff members who need it for their duties
- Confidentiality agreements signed by all our collaborators and subcontractors
- Regular backups and incident response plan
10. Your rights
Under Law 25 and PIPEDA, you have the following rights:
- Right of access to personal information we hold about you
- Right of rectification in case of inaccuracy
- Right to withdraw consent at any time
- Right to de-indexation and cessation of dissemination in certain situations
- Right to portability of your information (transmission to a third party of your choice, in a structured, commonly used technological format)
- Right to file a complaint with our Privacy Officer and, if necessary, with the Commission d’accès à l’information du Québec
To exercise these rights, write to us at info@performancesqualite.ca with proof of your identity. We will respond within a maximum of 30 days.
11. Confidentiality incident
In the event of an incident involving personal information and presenting a risk of serious harm, we will promptly notify the Commission d’accès à l’information du Québec as well as affected individuals, and we will maintain an internal log of such incidents in compliance with the law.
